General Terms and Conditions of Sale

These General Terms and Conditions of Sale (hereinafter “GTC”) apply to all purchase contracts concluded on www.undy.ch (hereinafter “Undy.ch”). Undy.ch is operated by Petignat Commerce SNC, Etangs 26, 2854 Bassecourt, Canton of Jura, Switzerland.

1. Product presentation

The presentation of products and prices on Undy.ch constitutes a non-binding offer. Simply adding products to the basket does not constitute a firm order. All information, product descriptions and photos on Undy.ch are provided for guidance only and are not contractually binding.

2. Order

Submitting an order constitutes an offer to Undy.ch to conclude a contract. Undy.ch is free to refuse any order, in whole or in part, without giving reasons. In this case, the buyer will be informed and any payments already made will be refunded. Any further claims are excluded.

3. Conclusion of the contract

The contract is concluded only upon receipt of the shipping confirmation sent by Undy.ch by email, and at the latest when the ordered items are dispatched.

4. Prices

All prices are net, in CHF (Swiss francs), including VAT. The applicable price is the one shown on Undy.ch at the time of ordering. Undy.ch reserves the right to change its prices at any time. Any additional costs (shipping costs, etc.) are shown separately during the ordering process.

5. Delivery

Deliveries are made exclusively within Switzerland and the Principality of Liechtenstein. The delivery address cannot be changed after dispatch. Delivery times are provided for guidance only and are not contractually binding.

If a delivery deadline cannot be met, the buyer has the right to terminate the contract from the 30th calendar day after the originally stated delivery date. Undy.ch will refund the amount already paid. Any further claims are excluded.

The goods delivered must be checked immediately. Damage, errors or incomplete deliveries must be reported to info@undy.ch within five calendar days of receipt. Each case is dealt with individually. No refund is granted; a replacement delivery may be offered depending on the circumstances.

6. Subscriptions

Undy.ch offers three types of subscription:

6.1 Undy Flex: monthly subscription

The Flex subscription is renewed and billed automatically every month. It can be cancelled at any time from the customer account, with immediate effect, provided that the next delivery has not yet been dispatched. If the current month's delivery has already been dispatched, the cancellation takes effect from the following month. The subscription can be paused at any time. Size and delivery address can be changed at any time in the customer account. No refund is granted if the customer cancels.

6.2 Undy Plus: prepaid subscription

The prepaid subscription is paid in a single payment for 3, 6 or 12 months. Early cancellation or a refund is not possible on the part of the customer. At the end of the term, the subscription renews automatically for the same duration and is billed again, unless it has been cancelled beforehand in the customer account. The subscription can be paused at any time.

6.3 Gift subscription

The gift subscription is paid in a single payment for 3, 6 or 12 months. It expires automatically at the end of the chosen period, without renewal. No refund is granted once the first delivery has been dispatched.

6.4 Cancellation by Undy.ch

Undy.ch may cancel a subscription at any time by giving at least 14 days' notice by email. In this case, the remaining value of the subscription will be refunded pro rata or, where possible, dispatched in a single delivery to close the subscription.

7. Returns and refunds

For reasons of hygiene, Undy.ch does not grant any general right of return on its products. All refunds are excluded, except in the case of a cancellation initiated by Undy.ch (see Art. 6.4). In the event of a damaged, incorrect or incomplete delivery, each situation is examined individually; a replacement delivery may be offered.

8. Payment and retention of title

Payment is made exclusively in Swiss francs. The available payment methods are shown during the ordering process. Credit card data is encrypted using SSL technology. The ordered goods remain the property of Undy.ch until the purchase price has been paid in full.

9. Data protection

The collection, processing and use of personal data are described in the Privacy Policy, which forms an integral part of these GTC.

10. Exclusion of liability

Any liability for slight negligence, indirect damage, consequential damage and loss of profit, as well as for damage resulting from delivery delays, is excluded.

11. Miscellaneous

These GTC and all legal relationships between Undy.ch and the buyer are governed by Swiss law, to the exclusion of private international law and the United Nations Convention on Contracts for the International Sale of Goods. The place of jurisdiction is the registered office of Undy.ch (Petignat Commerce SNC, Etangs 26, 2854 Bassecourt). Undy.ch reserves the right to amend these GTC at any time. The version in force at the time of ordering is authoritative.
